Welcome to Wake Up Sunni (“we”, “us”, “our”). Sunni (2025) Limited operates this online store and website at www.wakeupsunni.com, including all information, content, features, tools, products and services offered through it (collectively, the “Services”).
These Terms of Service (“Terms”) govern your use of the Services and constitute a binding legal agreement between you and Sunni (2025) Limited. Our store is powered by Shopify, which enables us to provide the Services to you.
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.
1. Access and Account
You must be at least 18 years old, or the age of majority in your place of residence, to use the Services. You agree to provide accurate, current and complete information when creating an account or placing an order, and to maintain the confidentiality of your login details. You are responsible for all activity that occurs under your account.
2. Our Products
We make every effort to display our products accurately, but colours and finishes may vary depending on your screen and settings. All product descriptions, prices and availability are subject to change at any time without notice. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion.
3. Orders
When you place an order, you are making an offer to purchase. Acceptance occurs only when Wake Up Sunni confirms your order and receives payment in full. We may decline or cancel any order for any reason, including stock unavailability or suspected fraudulent activity.
All purchases are subject to our Refund Policy. All products sold are for personal use only and not for resale or export.
4. Prices, Payment and Billing
All prices are listed in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) unless stated otherwise. Shipping costs are calculated at checkout.
We accept the following payment methods processed via Shopify Payments:
- Credit and debit cards, including Visa, Mastercard and American Express
- Shop Pay
- Apple Pay
- Google Pay
- Afterpay, subject to Afterpay’s own terms and conditions
You agree to provide valid and up-to-date billing and payment details. If your payment method is declined, we may cancel your order. Sunni (2025) Limited is registered for GST in New Zealand. Australian customers may be subject to Australian GST where applicable under Australian law.
5. Shipping and Delivery
New Zealand
We offer free standard shipping on all New Zealand orders. Orders are typically dispatched within 1–3 business days. Estimated delivery times within New Zealand are 2–5 business days once dispatched, depending on your location.
Australia
We ship to Australia via standard international courier. Shipping costs are calculated at checkout. Estimated delivery times to Australia are 5–10 business days once dispatched. International orders may be subject to customs duties or import taxes upon arrival in Australia, which are the responsibility of the customer.
General
Delivery timeframes are estimates only and are not guaranteed. Once goods are handed to the carrier, risk and title pass to you. We are not liable for delays caused by couriers, customs, or events beyond our reasonable control.
Your rights under the Consumer Guarantees Act 1993 (CGA) and Fair Trading Act 1986 (FTA) apply and are not limited by these Terms.
6. Consumer Rights and Refunds
New Zealand Customers
Nothing in these Terms affects your statutory rights under New Zealand law. If a product is faulty, not of acceptable quality, or does not match its description, you are entitled to a remedy under the Consumer Guarantees Act 1993. For change-of-mind returns or exchanges, please refer to our Refund Policy.
Australian Customers
For customers in Australia, our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
30-Day Return Policy
We want you to be completely satisfied with your Wake Up Sunni purchase. If you are not happy for any reason, you may return your item within 30 days of delivery for a full refund or exchange, provided it is in its original unused condition, in its original packaging, and accompanied by proof of purchase.
Return shipping costs are the responsibility of the customer unless the item is faulty or was sent in error.
To initiate a return, please contact us at admin@wakeupsunni.com. Refunds will be processed within 5–7 business days of receiving the returned item and issued to your original payment method.
7. Errors and Inaccuracies
From time to time, our Site may contain errors or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct these at any time, including after an order has been placed. In the event of a pricing error, we will notify you and provide a full refund if payment has already been made.
8. Intellectual Property
All content, logos, trademarks and materials displayed on the Services are owned by or licensed to Sunni (2025) Limited and are protected under New Zealand and international copyright and trademark laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written permission.
9. Third-Party Tools and Links
Our Services may include links or integrations with third-party tools or websites. We do not control and are not responsible for their content, policies, or actions. Use of third-party sites is at your own risk.
10. Relationship with Shopify
Sunni (2025) Limited is powered by Shopify Inc. Shopify provides the ecommerce platform but is not a party to your purchase. All sales and transactions are solely between you and Wake Up Sunni.
11. Privacy
Your personal information is collected, used and stored in accordance with the New Zealand Privacy Act 2020 and our Privacy Policy at www.wakeupsunni.com/pages/privacy-policy. Shopify also processes certain data in accordance with its own Privacy Policy at shopify.com/legal/privacy. By using our Services, you consent to this processing.
12. Feedback
Any feedback or suggestions you provide may be used by Sunni (2025) Limited for business purposes without obligation to compensate you. You warrant that your feedback does not infringe others’ rights or contain unlawful material.
13. Prohibited Use
You may use our Services only for lawful purposes. You must not:
- Use the Services to engage in illegal, fraudulent, or abusive behaviour
- Upload harmful code or attempt to disrupt the website
- Misrepresent your identity
- Infringe upon the intellectual property or privacy rights of others

16. Limitation of Liability
To the fullest extent permitted by New Zealand law, Sunni (2025) Limited, its directors, employees, agents and affiliates shall not be liable for any indirect, incidental, consequential, or special loss arising from your use of the Services or products purchased, except as required under the CGA.
Nothing in these Terms excludes or limits liability for death, personal injury, fraud, or any rights you have under New Zealand or Australian consumer law.
17. Indemnification
You agree to indemnify and hold harmless Sunni (2025) Limited and its affiliates, directors, employees and agents from any loss, damage, claim, or expense, including legal fees, arising out of your breach of these Terms or your violation of any applicable law or the rights of a third party.
18. Severability
If any part of these Terms is found to be invalid or unenforceable, the remainder shall continue in full force and effect.
19. Waiver and Entire Agreement
Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Sunni (2025) Limited with respect to your use of the Services.
20. Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights under these Terms without notice to you.
21. Governing Law
These Terms are governed by the laws of New Zealand, and the parties submit to the exclusive jurisdiction of the courts of New Zealand. For Australian customers, to the extent required by Australian Consumer Law, those provisions will also apply to your consumer rights.
22. Changes to These Terms
We may update these Terms from time to time by posting a new version on our website with an updated date. Material changes will be communicated as required by law. Continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
